Notice: Emergency Rule Scheduling 7-OH as a Schedule I Controlled Substance
A recent notice from state regulators related to the sale of 7-0H is reproduced in its entirety below.
Dear Division of Alcoholic Beverages and Tobacco Licensee,
On June 17, 2026, Florida Attorney General James Uthmeier signed an Emergency Rule that immediately places 7-Hydroxymitragynine (7-OH) on Florida's Schedule I list of controlled substances.
Effective immediately, the possession, sale, distribution, manufacture, or delivery of products containing 7-Hydroxymitragynine may be prohibited under Florida law, except as otherwise authorized by law.
What is 7-Hydroxymitragynine (7-OH)?
7-Hydroxymitragynine (commonly referred to as "7-OH") is a compound derived from kratom that has gained popularity in concentrated products marketed for stimulant, mood-enhancing, or opioid-like effects. According to the Attorney General's Emergency Rule, 7-OH presents a significant public health and safety concern due to its potency and potential for abuse.
Impact on Licensees
Licensees should immediately review their inventory and discontinue the sale or distribution of any products containing 7-Hydroxymitragynine (7-OH), including products marketed as:
"7-OH"
"7-Hydroxymitragynine"
"Hydroxie"
Other products containing concentrated 7-Hydroxymitragynine that may be affected by this rule.
Licensees are responsible for ensuring compliance with all applicable federal, state, and local laws and regulations regarding products offered for sale.
